2015 Candidate Chemical List Amendment Rulemaking


The Department of Toxic Substances Control (DTSC) is seeking public comment on proposed rulemaking which will correct two citation errors and update one authoritative list found in Article 2 of the Safer Consumer Products regulations.


DTSC proposes to amend Title 22, California Code of Regulations section 69502.2(a)(1) to correct or update citations for three authoritative lists included in the Candidate Chemical List as follows:

- Correct the citation for the European Union candidate list of Substances of Very High Concern for endocrine disrupting properties;

- Update the citation for the Report on Carcinogens, United States Department of Human Health Services, Public Health Service, National Toxicology Program;

- Correct the citation for the European Union candidate list of Substances of Very High Concern for persistent, bioaccumulative and toxic, or very persistent and very bio accumulative properties.

Ensuring that authoritative lists used to identify Candidate Chemicals are current and cited correctly minimizes potential confusion as to which chemicals may be identified by DTSC as a Chemical of Concern in a Priority Product. This action will have no adverse economic impacts on the private sector because it does not impose regulatory requirements on businesses or individuals.

DTSC will also hold a public hearing on this proposed regulation on November 16, 2015 from 1:00pm to 3:00pm in the Klamath Training Room at the Cal/EPA Building at which point comments may also be submitted.
